1. Agreement to TermsThese Terms of Service ("Terms") constitute a legally binding agreement between you and Bartosz Salwiczek Software, operating under the trade name Workflow Boost ("Workflow Boost," "we," "us," or "our"), governing your access to and use of our applications available through the monday.com marketplace. By installing, accessing, or using any of our applications, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our applications.

2. Eligibility You must be at least 16 years of age to use our applications. By using our applications, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement. If you are using our applications on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Description of Services We develop and provide applications that integrate with the monday.com platform. Our current applications include Column to Column, Advanced Time Triggers, QR Flow, Subitems Pro Automations, and Column Changes Guard. These applications are designed to enhance and extend the functionality of the monday.com platform.

4. Privacy and Data Collection Your use of our applications is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using our applications, you consent to the practices described in the Privacy Policy.

5. Third-Party Services Our applications operate within the monday.com platform. The use of third-party services varies by application:

Column to Column and Subitems Pro Automations run entirely on monday.com infrastructure and do not connect to external services.

Advanced Time Triggers uses Cloudflare for hosting, and Google Analytics for usage analytics.

QR Flow uses Cloudflare for hosting.

Column Changes Guard runs on monday.com infrastructure and uses PostHog for product analytics.

Your use of our applications is also subject to monday.com's terms of service and privacy policy. We are not responsible for the practices or policies of these third-party services.

6. Intellectual Property All intellectual property rights in our applications, including but not limited to software code, design, graphics, logos, and documentation, are owned by Bartosz Salwiczek Software or our licensors. These Terms do not grant you any rights to our intellectual property except for the limited license to use the applications as intended. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works based on our applications without our prior written consent.

7. Acceptable Use You agree to use our applications only for lawful purposes and in accordance with these Terms. You agree not to: (a) use our applications in any way that violates applicable laws or regulations; (b) attempt to gain unauthorized access to our systems or networks; (c) interfere with or disrupt the integrity or performance of our applications; (d) use our applications to transmit harmful code or conduct any form of attack; or (e) use our applications in any manner that could damage our reputation or goodwill.

8. Disclaimer of WarrantiesOUR APPLICATIONS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT OUR APPLICATIONS WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WORKFLOW BOOST, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) OUR APPLICATIONS; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA; OR (D) ANY OTHER MATTER RELATING TO OUR APPLICATIONS. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR APPLICATIONS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. IndemnificationYou agree to indemnify, defend, and hold harmless Workflow Boost and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of our applications; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) your violation of any applicable laws or regulations.

11. Modifications to Applications and TermsWe reserve the right to modify, suspend, or discontinue any aspect of our applications at any time without notice. We may also update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a new "Last updated" date. Your continued use of our applications after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

12. TerminationYou may stop using our applications at any time by uninstalling them from your monday.com account. We may suspend or terminate your access to our applications if: (a) you breach these Terms; (b) you use our applications in a manner that could cause legal liability or disrupt others' use; (c) we are required to do so by law; or (d) we discontinue the application or service. Where practicable, we will provide reasonable notice before termination, except in cases of serious violations. Upon termination, your right to use our applications will cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Governing Law and Dispute Resolution These Terms shall be governed by and construed in accordance with the laws of Poland. However, if you reside in a country with mandatory consumer protection laws (including but not limited to EU member states, the United Kingdom, or the United States), nothing in these Terms limits your rights under those laws, and such laws shall apply to the extent they provide you with additional protections.

Informal Resolution: Before initiating any formal proceedings, we encourage you to contact us at contact@workflow-boost.com to attempt to resolve any dispute informally. We will make reasonable efforts to address your concerns within 30 days.

Formal Disputes: If informal resolution is unsuccessful, any disputes shall be resolved in the competent courts of Poland, except that: (a) consumers in the EU may bring proceedings in the courts of their country of residence; (b) consumers in other jurisdictions may have the right to bring proceedings in their local courts as required by applicable law.

14. Severability If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Entire Agreement These Terms, together with our Privacy Policy, constitute the entire agreement between you and Workflow Boost regarding your use of our applications and supersede all prior agreements, understandings, and communications, whether written or oral.

16. Waiver Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
